1. Scope and user responsibility
This policy explains how to report material on choppa.lol that you believe infringes copyright and how affected users may respond. It applies to profile backgrounds, music, video, avatars, images, fonts, templates, and any other uploaded or linked material.
Profile owners are responsible for clearing all rights before upload. The service provider's ability to remove material after a report does not authorize an upload and does not transfer the profile owner's responsibility to the service provider.
2. What permission must cover
Permission must cover the uses actually made through choppa.lol, including hosting, reproduction, processing, transmission, public display or playback, and making the file available on demand. Music used with video can additionally require synchronization permission.
For commercial recordings, permission may be required from more than one rights holder, including the songwriters or publishers, the owner of the sound recording, and performers. A purchase receipt or streaming subscription is not an upload license.
3. Before you upload
Use original material, public-domain material whose status you verified, or material covered by a license that expressly permits this public online use. Keep the license, contract, source record, and any required attribution. Do not upload first and seek permission later.
If you rely on quotation, criticism, review, caricature, parody, pastiche, or another legal exception, confirm that every legal condition is met. If you are unsure, do not upload the material until you have obtained qualified legal advice.
4. Submitting a copyright notice
Send a written notice to the legal contact in the Provider Notice. A complete notice should include:
- your full name, organization if applicable, email address, and a physical or electronic signature;
- identification of the copyrighted work or a representative list of works;
- the exact choppa.lol URL and a clear description of the allegedly infringing material;
- enough information for us to locate the material without searching broadly;
- a good-faith statement that the disputed use is not authorized by the rights holder, its agent, or law; and
- a statement that the information is accurate and that you are the rights holder or authorized to act for that person, under penalty of perjury where applicable.
5. Review and action on a notice
We acknowledge and review sufficiently precise notices without undue delay. We may request missing information, temporarily restrict access, remove the material, preserve relevant records, or take account action. Where lawful, we may send the notice and supporting information to the affected account holder.
We consider the information provided, apparent legal exceptions, prior decisions, and other reliable information. A report does not guarantee removal, but actual knowledge of unlawful material can require prompt action.
6. Counter-notice and review request
If your material was removed by mistake or misidentification, send the legal contact in the Provider Notice your signature, contact details, identification and prior URL of the material, the reason the use is lawful, and a statement under penalty of perjury where applicable that removal resulted from mistake or misidentification.
Include any consent-to-jurisdiction statement required by the law governing the notice. We may forward the counter-notice to the reporting party. Where the applicable process permits, we may restore material if the reporting party does not begin legal action within the relevant period.
7. Repeat infringement and abusive reports
We may warn, restrict, or terminate repeat or serious infringers after considering the nature, frequency, and apparent intent of violations. Knowingly false, fraudulent, or misleading notices and counter-notices may create legal liability and may result in account action.
8. Records, privacy, and disclosure
We may retain notices, counter-notices, relevant account records, and moderation decisions for legal compliance, dispute handling, fraud prevention, and the establishment or defense of claims. Personal data is handled as described in the Privacy Policy and may be disclosed where required by law or necessary to process a claim.
9. Legal contact status
This policy does not state that the service provider has registered a statutory copyright agent in any jurisdiction or obtained blanket music licenses. The Provider Notice identifies the current legal contact. Any registration, licensing, or regulatory duties that apply to the Service must be satisfied separately.
